WASHINGTON -(INS)- The government in an attempt to get a new indictment. Government said Friday it will not press charges against a Chicago reporter under the existing indictment.
Earlier, the defendant's lawyers lost a motion to dismiss the indictment when Kirkland overruled their contention that it was full of holes."
Assistant U. S. Attorney Frederick Smithson told a Federal court that, instead, the case against newsman Ray Brennan will go before a new Grand Jury. Smithson said the original indictments contain several defects.
Brennan, a reporter for the Chicago Sun-Times, allegedly represented himself as a Senate Crime Committee employee to obtain secret testimony by Captain Dan (Tubbo) Gilbert, former chief investigator for the Cook County, Ill., District Attorney.
District Judge James R. Kirkland originally ordered the newsman to go on trial Tuesday, but that plan was upset by the subsequent decision of the government lawyers.
Smithson said government witnesses scheduled to appear at Brennan's trial will now go instead before a new Federal Grand Jury
