When the question of concurrence in the amendments made by the House came up, Maj. FLEMING of Madison, who had voted for the bill on its passage through the Senate, desired to read certain resolutions of instruction, which he had subsequently received from a portion of his constituents.
The President decided that such a course would be out of order. Mr, Fleming in accordance with these resolutions, then offered the following amendment, which was also declared to be out of order : "Provided. That the provisions of this bill shall not take effect until the first day of January, 1844" Mr. F. desired that the instructions under which he acted might be spread upon the Journal, which was refused.
The House in making its amendments, having neglected to specify the amount of salary which shall be allowed the President, Mr. Terry offered an amendment on the subject, which was lost.
Mr. Terry then moved to lay the bill and amendments on the table; which motion the chair decided was out of order. From this decision Mr. T. took an appeal ; but the chair was sustained by a vote of 18 to 8. The bill was then finally disposed of.
Thus has the Huntsville Branch, after a desperate struggle, gone by the board, with all the rest, As the old woman said to her husband, however, who was just recovering from a violent spell of sickness, which would have killed almost anybody else. "Ah! old man, and but ye'r tough to die."
