Information Filed Against Deeney, Kelly and Hickey for Murder.

BUTTE, Nov. 16.—This was the last day on which the county attorney could file information against Deeney, Hickey and Kelly in the Pearose murder case, but Mr. Baldwin did not let the day pass without attending to this part of his duties, although it was 10:30 to-night when he hunted up Clerk Clark and filed an information in Judge Pemberton's court reading as follows:

State of Montana vs. William Deeney, Philip Hickey and Eugene Kelly

Information for murder in the first degree.

William Deeney, Philip Hickey and Eugene Kelly are accused by the county attorney of Silver Bow county, Mont., by this information of the crime of murder in the first degree, committed by them as follows: The said William Deeney, Philip Hickey and Eugene Kelly on or about the 10th day of June, 1891, in Silver Bow county, did then and there feloniously and willfully and of their deliberately premeditated malice aforethought make an assault on one William J. Pearose with a certain revolving pistol which then and there was loaded with gunpowder and leaden bullets; they, the said William Deeney, Philip Hickey and Eugene Kelly, did then and there feloniously and of their deliberately premeditated malice aforethought shoot off and discharge at and upon the said William J. Pearose, thereby and by thus striking the said William J. Pearose with one of the said leaden bullets, thereby inflicting on and in his head one mortal wound of which said mortal wound the said William J. Pearose then and there instantly died, and so the said William Deeney, Philip Hickey and Eugene Kelly did in the manner and form aforesaid feloniously, and of their deliberately premeditated malice aforethought kill and murder the said William J. Pearose, all of which is contrary to the form of statute in such cases made and provided, and against the peace and dignity of the state of Montana.
