Returned the Money but Was Sent to the Penitentiary.

John C. Brithold and Fred. Zensor bunked in the same common room in a cheap lodging house. During the night Zensor got up and robbed his bed-fellow of $18. Before going to sleep Brithold put his coat and vest above his clothes. In the morning part of his clothing, and his money, were gone.

Zensor said when he got up during the night he took the coat and vest by mistake. Afterward he discovered the money in the pocket, and concluded to keep it. He had intended to go back to Europe, as he had ascertained that his wife was in a critical condition, and the $18 and his own $8 would enable him to take a trip over to Germany.

Complainant said they retired about eight o'clock, and their clothes were together. The door was then locked. About ten o'clock the janitor brought in another guest, and when he looked up the man that slept next to him was gone.

Prisoner said he had $7 of the money, and was willing to give it up.

Prisoner counted out the $7 and returned it to complainant.

The court said they would deal leniently with him in consideration of having given up part of the money. Two months in the Penitentiary.
