As will be seen in our Carson notes, in the suit of Lyon county against the State of Nevada, Lyon county claimed to be the first county for expenses incurred at the special election of February 11, tried in Carson last week, judgment has been given the county for the full amount claimed. The sentiment the State sealed those bills the Enterprise said it would have to pay them in full as audited by the several Boards of County Commissioners in this State, audit will.

To the State authorized the several counties to contract for the bills and made an appropriation, and when it found the appropriation it had made was not enough, it made an extra appropriation of $4,000. This is the one the counties are bucking against and they are going to test the law. It is there in that purpose—Virginia Enterprise.

The Enterprise has a theory that the State would be compelled to pay the full amount of the expenses of the special election, as certified to by the several Boards of County Commissioners for the payment of said election expenses is so explicit that a Chinaman who can read the English language need not err therein. See Statutes of 1889, page 171.

In addition to the amount appropriated by the Act of January 23rd, above cited, it was ascertained that the appropriation of $1,000 to cover said expenses was insufficient and an Act was approved March 5th, 1889, appropriating the sum of $1,000 to—An Act to provide for the payment of the expenses of the special election of February 11, 1889, in excess of the amount heretofore appropriated for that purpose.

There is no question that the State will be compelled to pay the full amount, provided the several counties take action to recover its and any county which refuses or neglects to make an attempt to collect it from the State should pay the money from its General County fund.
