On Monday, the 1st November, the supreme court of Vermont, called for the purpose of trying George Tibbers and George Whitney, for the murder of Stephen Gordon, commenced their sessions at Bennington. The jury brought in a verdict "not guilty of murder but guilty of manslaughter." Judge Tyler then addressed the jury on the subject, and gave his ideas of murder and manslaughter; deducing the opinion that, in this case, if the persons were not guilty of the former they were clearly innocent of the latter. The jury were then directed to reconsider their verdict—but after retiring half an hour, persisted in giving the same. The prisoners are condemned to three months imprisonment, and to pay a fine of 400 dollars, with costs of suit: giving bonds of surety in 500 dollars each for their good behaviour for ten years.
