New Trial.—Gelabert who was convicted of murder in Stockton last week, has been granted a new trial, it being shown that the jury decided by ballot whether they should bring in a verdict of murder in the first or second degree. The affidavits of nearly all the jurymen in the case show that they had no idea of balloting as charged, but to find out how they stood and if there was a probability of agreeing. One of the jurymen, however, thought he was casting his ballot to see which side should win, and he changed his opinion from the minority to the majority side after the ballot. Gelabert has been convicted by two juries, the next will be his third trial.
