VANCOUVER, B. C., Mar. 28.-Attorney S. S. Taylor announced this evening he would be prepared to offer witnesses in behalf of B. F. O'Neil, former Wallace banker, at the hearing tomorrow. An effort to ascertain whom Taylor has in Vancouver for the purpose failed to elicit anything further than that the defense is prepared to spring a surprise.
With the departure of Wayne for Wallace the entire matter of prosecution is in the hands of J. W. De Farris, and Farris is as much in the dark as any one as to Taylor's program.
In the hearing Friday Taylor says he will direct an attack upon the statutes. He claims that issuing a false report is not an offense under the criminal code of Canada, though covered in the banking act. As no evidence of intent to defraud is required under the banking act the issuance of a false report does not carry with it evidence of fraud. He claims the Idaho authorities, under the treaty with the United States, can not avail themselves of statute for extradition.
