WASHINGTON The Civil Aeronautics Board has slapped down a motion by 69 mail-carrying railroads to intervene in its setting of a "temporary rate" of 18.98 cents a ton-mile to be paid the airlines for flying three-cent "surface mail" on the West Coast.
After denying the railroads' motion, CAB ordered the rate into effect.
Meanwhile, a hearing has been set for Dec. 13 in U. S. District Court here in the suit filed by five major western railroads -- Atchison, Topeka & Santa Fe, Great Northern, Northern Pacific, Southern Pacific and Union Pacific -- for a preliminary injunction against the Postmaster General.
The West-Coast service, which started Nov. 22, would be stopped if the injunction is granted.
Nov. 22 also is the effective date of the new temporary rate.
The final rate, which will be set later, may be higher or lower than the temporary rate, CAB said in its order.
