Despite the fact that Federal Judge F. A. Geiger instructed the jury from the bench that there was no verdict possible but one of guilty, and requested the jury three times to return a guilty verdict without retiring for deliberation, it took three and a half hours, and a request for special instructions, before a guilty verdict was returned in the case of George Roebel, Hubertus, Wis., farmer, late yesterday.
Denied Selling Liquor.
Roebel had offered to plead guilty to the charge of maintaining a nuisance inasmuch as he manufactured intoxicants for his own use, but denied the sale of whisky. The judge refused to accept a qualified plea, and ordered a jury trial.
The main interest of the jury was in whether making of whisky for one's own use constituted a "nuisance" and whether mere possession of a still constituted one.
Fines Man $500.
The judge instructed them that such was the case, and after deliberating, the guilty verdict was returned.
Stating that inasmuch as he had directed the not guilty plea and the jury had had considerable doubt he would show clemency, the judge let Roebel off with a fine of $500.
