EXPATRIATION.
This right, necessary to the very power of loco-motion, seems to have become so very clear, that in principle it is never denied, but whenever asserted it is suddenly answered Great Britain will never surrender it. We know of no nation that denies the right, save Great Britain. The Napoleon code expressly recognizes it, but this, as authority, will not be admitted by the Federal party.
The Spanish Cortes have recently framed a new constitution; it is a work of great talent and profound knowledge of mankind; it is peculiarly interesting to the American reader. The similitude between their new government and our own is more striking, than we could have supposed could exist between a limited monarchy and a Representative Democracy. We hope in a day or two to present to our readers a synopsis of its principal features. We only quote at the present a single item to shew that it declares the right of Expatriation in the fullest extent.
In Title 2d. chap. 4, it provides:
Art. 18. Those are Spanish citizens who are born of Spanish parents in any part of the Spanish dominions and reside in the said dominions.
Art. 19 Foreigners who already enjoying the rights of Spaniards have obtained from the Cortes letters of citizenship.
Art. 20. provides how such rights are obtained.
Art. 24. The Rights of Spanish Citizenship are lost (inter alia,)
1. By being naturalized in another country:
2 By accepting an employment from a foreign country.
We trust our federal junto will not deny the authority of a body whose wisdom, virtue and intelligence have received from them such unqualified panegyric.
