Trailer Firm Hit for Law Violations
The Department of Justice, upon the recommendation of the U.S. Department of Labor, has charged P.I.E. Trailer Manufacturing, Inc. and Ellsworth Montrie of 5430 Stickney Avenue of Toledo, with wilful failure to pay overtime and other violations of the Federal Fair Labor Standards Act.
The criminal information was filed by Assistant U.S. Attorney Carl F. LaRue, and is based upon data obtained by investigators of the U.S. Labor Department's Wage and Hour Division.
The information charges that the firm falsified time and payroll records of certain of its employees by showing fewer hours than actually worked and lower rates of pay than were actually received by employees, and purporting to show time and one-half payment for overtime work although the employees received only straight time rates.
In addition, the defendants are charged with failure to pay 21 employees time and one-half of their regular rates for overtime work after 40 hours per week during the period covered by the information.
The P.I.E. Trailer Manufacturing, Inc. firm is engaged in the business of manufacturing, re-building and repairing of truck trailers for both local and out-of-state customers.
