A Fearless and Patriotic Judge—Judge Paddack's Decision.
We call especial attention to the Law Report in this morning's Enquirer, especially to the prompt and decided action of Judge Paddack, of the Probate Court in the habeas corpus case against Lieutenant Moore. That officer, for a most outrageous contempt of Court, and for a violation of law, was fined $25 and costs, and imprisoned twenty-four hours in the county jail, in the dungeon, on bread and water. In this vindication of the civil authority as paramount to the military, Judge Paddack has proved himself a fearless and patriotic Judge, and deserves and will receive the thanks of the community. It is high time that the impatience of the military gentlemen was checked, and that they were made to know that, like all the rest of us, they are responsible to the civil authority. We only regret that the Colonel, who, according to the report of the Lieutenant, gave him instructions to defy the Court, was not on hand to receive the sentence of the Court. We can tell the shoulder-straps that the day has gone by when they can tyrannize over people with impunity. The great writ of habeas corpus is not suspended in Ohio.—Cin. Enq., Jan. 1.
