Set Date For Second Trial Of Daugherty

New York, Dec. 31.-()--The second trial of Harry M. Daugherty, United States attorney general in the administration of President Harding and Thomas W. Miller, former alien property custodian, charged with defrauding the government of their "fair and impartial" service will begin on February 7 before Judge Knox.

Richard Merton, German capitalist, who testified at the first trial which resulted in disagreement on the part of the jury will be on hand to testify again, Martin W. Littleton, Merton's attorney, notified Assistant United States Attorney Leisure.
