Boy's Abductor Waives Jury Hearing and Judge Will Decide
Warren, Ohio, March 15.—(AP)— The trial of Dowell Hargraves, 31, for the kidnapping of 11-year-old James Dejute, of Niles, was concluded this morning, with the state demanding the maximum penalty of life imprisonment. Common Pleas Judge Lynn B. Griffith indicated he would render his verdict tomorrow.
Hargraves has waived a jury trial, placing his fate in Judge Griffith's hands. Defense counsel did not deny Hargraves' part in the abduction of the Dejute boy, son of James Dejute, Sr., wealthy Niles contractor, but did argue that the state had failed to prove there was an attempt at extortion, as the indictment charged, and, therefore, the state had no case.
The court overruled a motion to dismiss the case.
