WIDOW OF TOM MARTIN THEN PERMITTED TO RETURN HOME
PROSECUTOR STATES SHE WILL BE TRIED FOR ACCESSORY TO NED MARTIN MURDER

AMOUNT OF BOND WOULD NOT INDICATE TRIAL FOR MURDER IN FIRST DEGREE

Mrs. Abe Pritt, widow of Tom Martin, was admitted to $2,500 bond in circuit court here late Tuesday afternoon by Judge H. Roy Waugh. Mrs. Pritt is held for murder in connection with the death of her brother-in-law, Nathaniel "Ned" Martin, ten years ago. Edward Martin and her former husband Tom Martin, father and brother of Nathaniel, are dead.

Mrs. Pritt was taken from Mill Creek to Squire McElhwee's court, Valley Bend Tuesday where she waived examination and was later brought to Elkins where she was taken to the court house and instead of being confined in the jail pending action by the grand jury was permitted to give bond.

Prosecuting Attorney R. S. Irons stated this morning that the woman will be tried as an accessory to murder, if an indictment is returned by the grand jury, and the amount of bond required would not indicate that the state would try to prove first degree murder.

This case developed after the finding a skeleton and rusted gun in the woods near Mill Creek late Saturday. At an inquest held Sunday the gas and fragments of clothing found by the skeleton were used to identify it as that of Nathaniel Martin.

Witnesses told of the killing of the man at the hands of his father, brother and it was stated that Martin, now Mrs. Pritt, was seen assisting in the removal of the body.

Mrs. Pritt is said to deny any part in the crime.
