Simple Matter
Local boards welcome the indication of their acts by the board of appeal when registrants avail themselves of their right to legitimate appeals, John McCormick, Territorial Selective Service Director, stated today. He said:
A local board does not object to havings its classifications appealed. Such procedure will affirm the opinion that, in a large proportion of instances, the determinations of the board are correct and yet it is frankly recognized there is a possibility of error and regulations provide for its correction.
There is no involved legal procedure for appeal," Mr. McCormick said, "If the registrant wishes to appeal to the board of appeal, he may file with the local board within ten days of notice of classification a written notice of appeal. This simple statement of the appellant, showing that the individual has the right of appeal and specifying in what respect he believes the board to have erred, may direct attention to any information in the registrant's file which he believes the local board has failed to consider or has not given sufficient weight; and may set out in detail any information which was offered to the local board and which the board failed to include in the registrant's file.
Appeal to the Board of Appeal may also be initiated simply by the appellant's signing the "Appeal to Board of Appeal" on the registrant's questionnaire. They may not appeal on physical grounds.
The registrant's file is then forwarded to the board of appeal. After decision of the board of appeal the local board is informed of the decision and sends to the registrant either a Notice of Continuance of Classification or Notice of Classification, depending upon whether the board of appeal affirmed the local board's classification or gave the registrant another classification.
Decisions of the board of appeal are not published by the board, but are announced in the same manner as an original classification of the local board," Mr. McCormick said.
