The indictment for the alleged assault upon Crooks, and forcible entry into his dwelling house, was ordered by the court to be discharged—Mr. Crooks, and the Attorney for the Commonwealth assenting. This proceeding will forever bar all civil actions for damages against the persons mentioned in that indictment.
Besides this arrangement, Crooks executed a deed of release and discharge of all actions and rights, and causes of action, in respect to every person, in any manner concerned in the supposed offence, either as being present, or advising, or ordering it; together with a bond and covenant to indemnify each and all of them from all civil suits whatever : and in case any criminal prosecutions shall be hereafter commenced against either of these persons, he is to appear before the court where they shall be pending, and acknowledge that he has received satisfaction for the offence. If he refuses or neglects to do this, he will be obliged to refund the douceur which he has received, and subjects himself to heavy damages for every refusal.
The other indictment, which is for bringing certain persons, taken at Crooks's tavern, into this State, is continued to the next term of the court.
The counsel for the defendants, were—Richardson, Esq., of Dedham, and Samuel Correy and John Whipple, Esqrs., of Providence.—For the Commonwealth, P. Merrick, Esq., of Worcester.—Prov. Jour.
