March 21—A suit seeking $1,176 in a treble damage action was filed yesterday in U. S. District Court, Phoenix, by the Office of Price Administration against operators of the Stewart Motor Company, a Phoenix concern on East Van Buren street.
The three-count complaint charges Jack P. Stewart, Rose M. Stewart, Spencer D. Stewart and Mary Jane Stewart with selling a motor vehicle to the War Relocation Authority a year ago on an "as is" basis for $1,962 when the ceiling price without a warranty was $1,570.
Three times the amount of the alleged $392 overcharge is sought by the OPA as well as $50 or treble the amount of other claimed overcharges in used car transactions.
