96. An act authorizing the erection of a dam across an arm of James river, opposite to Cabell's Island, to be erected by the corporation of the town of Lynchburg, for furnishing the town with water.
97. An act authorizing the payment of a sum of money to the representatives of George N. Belches, dec'd.
98. An act authorizing three elections in the county of Lewis, the first at the house of Daniel Farnsworth, east of the Buchanan mountain; the second at the house of Benja. Conrad, on the Little Kanawha river, in the south part of said county, and the third at Benjamin Riddle's house, in the western part of the said county, to be at the same time with the elections at the court house.
99. An act incorporating the Tuckahoe canal company, with a capital of $20,000, to construct a canal from some point on the James river canal, on the western side of Tuckahoe creek, to some point on said creek in Goochland county, near Crouch's coal pits. The canal to be completed within five years.
100. An act concerning Samuel Tinsley.
101. An act incorporating a company for improving the navigation of the Rivanna river, with a capital of $100,000.
102. An act imposing taxes for the support of government, makes no alteration in the taxes imposed last year.
103. An act to amend the act entitled, an act to reduce into one, the several acts for the better securing the payment of rents, and preventing the fraudulent practices of tenants and to regulate the practice of suing out and prosecuting writs of replevin, prescribes that when goods and chattels shall be distrained or attached for rent in arrear, where the rent is payable in a part of the crop, &c. the same proceedings shall be had as under the 12th and 13th sections of the act of which this is amendatory, allows the tenant to contest the right of the landlord to sue out an attachment for rent not due, and if it appear that the landlord had not just cause to suspect a removal of the effects from the leased tenement, they shall be restored to him with costs, and allows interest on rent in arrear from the time when it became due.
104. An act to alter and amend the act entitled, an act to reduce into one the several acts to regulate the solemnization of marriages, prohibiting such as are incestuous, or otherwise unlawful, to prevent forcible and stolen marriages, and for the punishment of the crime of bigamy, makes the marriage of a man with his deceased wife's sister, a misdemeanor punishable by fine and imprisonment, or both, at the discretion of a jury.
105. An act to amend the act entitled, an act reducing into one the several acts concerning the fees of certain officers, and declaring the mode of discharging the said fees, prescribes the fees which the clerks of the county and corporation courts may demand for services therein set forth, and requires the Judges of the Superior courts of law, and of the several county and corporation courts, to give in charge to the grand juries all the laws relating to the fees of the clerks of the superior and inferior courts of law and chancery.
106. An act extending the jurisdiction of the superior court of chancery and for other purposes.
107. An act to amend an act entitled an act releasing to Thomas Fretwell Goodwin, the commonwealth's right to a certain tract of land.
108. An act releasing to Charles Robertson and others, the Commonwealth's right to certain real estate.
109. An act for raising a sum of money by way of lottery for the benefit of the Richmond dock, authorizes the sum of fifty thousand dollars to be raised.
110. An act concerning lands returned delinquent for the non payment of taxes, prescribes, that persons claiming title to such lands, for taxes due before the 1st of April, 1827, who shall prove that prior to the passage of this act, they were entitled to the same, by purchase, &c. to the court of the county, &c. where the lands lie, then judgment shall be given, exonerating the lands from all arrears of taxes and damages anterior to the date of the purchase, a copy of the record to be filed with the Auditor, and the delinquent list corrected accordingly; provided always, that the Attorney for the Commonwealth appeared to defend her interest; if taxes have been erroneously charged, the court are authorized, in like manner, to exonerate the land. The act allows until the 1st of July, 1827 for the redemption of lands, &c. vested in the Literary Fund, the redemption to be made upon the payment of the taxes due at the time of vesting, with damages and the taxes since: relinquishes to persons deriving title under a grant from the Commonwealth, all such lands vested as aforesaid, where the grant is dated prior to such vesting, and where the lands have been settled and improved, upon the payment of all taxes due thereon, with ten per cent. damages on the amount due: and directs the auditor to cause the act to be published for two months.
111. An act authorizing James Wheatley to erect a toll bridge across the Rappahannock river.
112. An act concerning branch pilots on the river Rappahannock; requires that they shall not be compelled to pilot any vessel ascending or descending the said river, below its mouth, unless coming from sea in distress, regulates the fees to be paid for their services, and if no pilot is received on board, half fees are required for the benefit of poor and disabled pilots, their widows and children, reduces the size of the pilot boats, and gives the pilot who conducts a vessel up the preference in piloting her down the river.
113. An act to alter and amend an act entitled, an act changing the times of holding the fall superior courts in the third circuit, passed Feb. 16th, 1826, changes the time for holding the superior court of Prince William county, to the third Monday after the 4th Monday in April and August in every year.
114. An act concerning James B. Ferguson.
115. An act to punish the burning or otherwise injuring of public property, and for other purposes, makes the burning a bridge, the destroying or injuring any canal, or appurtenance thereof, each of the value of $100 dollars, felonies, punishable, if committed by a free person, with confinement in the Penitentiary, not less than two nor more than ten years, and if a slave, with death without benefit of clergy; and repeals the 41st section of the act prescribing the method of proceeding against free persons charged with crimes, in indictments, informations, &c. passed February 26, 1819.
116. An act for re-building Gauley Bridge, the payment of existing contracts, and for other purposes, directs the James River Company to dispose of so much of the James River surplus and appropriation fund, belonging to the fund of Internal Improvement, as will produce $40,000 dollars; of which, so much as shall be necessary for re-building said bridge, and $25,000 thereof are appropriated to comply with existing contracts and complete the unfinished work of the company; prescribes the tariff of tolls on the tow-path of the mountain section of the canal; gives the commissioner power to change the toll gates on the road, and make contracts for keeping the same in repair to erect buoys and ring-bolts on the Kanawha river, and make all necessary arrangements for collecting said tolls, and fixes the salary of the commissioner at $800.
117. An act altering the stated meetings of the Visitors of the University and for other purposes, changes said meetings from the first Mondays in April and October, to such times as the Visitors shall from time to time, prescribe, and authorizes them for the purpose of paying the debts of the University, to borrow not exceeding $15,000, and to pledge for its re-payment any part of the annual appropriation of $15,000, and any part of its other unapplied income.
118. An act to authorize the enlargement of Shockoe warehouse in the city of Richmond, and for other purposes.
119. An act authorizing the President and directors of the Literary Fund to grant the privilege to persons who have borrowed sums of money of that Fund to pay by instalments, allows five equal annual instalments, to commence on the 1st of April, 1827, for paying in the said debts.
120. An act concerning the Armory and for other purposes, authorizes the Executive to suspend the repairs of arms heretofore directed, and to remove as many rifles and muskets to the Lexington Arsenal, as it will contain; repeals the provisions of the existing laws, allowing the captain of the public guard, compensation as superintendent of repairs of arms, and directing certain arms reported unfit for service, to be sold: and authorizes the Executive to substitute these arms for those now in the hands of the militia; directs them to cause the gun carriages to be inspected, and preserved where deemed worthy of preservation, and cause to be procured, timber for mounting fifty pieces of artillery, to have the exterior of the buildings re-painted and repaired, and to purchase a site for the erection of an additional arsenal; directs the adjutant General to contract for repairing and packing such arms as are worthy thereof, and to sell the materials belonging to the State necessary therefor; and authorizes the Executive to loan for the use of the students of the University, one hundred muskets.
121. An act concerning the Penitentiary Institution, directs the superintendent to procure a wool spinning machine, authorizes him, with the approbation of the attending physician, to withdraw any convict from solitude, when the health of the convict requires it, repeals the 13th section of the act concerning said institution, passed 9th of March, 1824, and revives the 13th and 15th sections of the act to reduce into one the several acts, &c. for establishing a Penitentiary house and for the punishment of crimes, passed 6th of March, 1819, and allows the general agent and storekeeper, two thousand dollars as salary.
122. An act authorizing a sale of certain lands, whereof James S. Gilliam died seized, and for other purposes.
123. An act concerning appeals in cases arising under the by-laws of the town of Wheeling.
124. An act to amend the tariff of tolls on the Blue Ridge Canal, and for other purposes, raises the tolls on the canal, and fixes the toll for passing the bridge, exempting persons navigating boats on the canal or riding in carriages across the bridge from the payment of toll, and gives the Commissioner of the Kanawha road the same power in relation to the appointment of the collector of tolls, on the canal, bridge and tow-path as he now has on the said road, and exempts him from giving separate bonds.
125. An act to Confirm a law passed at the present session of the General Assembly of Maryland entitled, an act to incorporate the Baltimore and Ohio Rail Road Company, incorporates the company with a capital of three millions of dollars, for constructing a rail road from the city of Baltimore, to some point on the Ohio river, not lower than the mouth of the little Kanawha river.
126. An act incorporating a company to construct a turnpike road across the Warm Spring Mountain.
127. An act establishing certain inspections of flour and Indian meal, and for other purposes, to be at the Scotch mills in the county of Tyler, at Chapman's ferry in the county of Brooke, and at Gamble's warehouse on the Ohio river, and authorizes the Governor to appoint Commissioners to act in conjunction with commissioners from the State of Pennsylvania, to lay out a road from Green county, Pennsylvania, to Middle Island creek, Virginia.
128. An act to alter and amend an act entitled, an act to alter and amend the several acts authorizing a lottery for the improvement of the navigation of Quantico creek in the county of Prince William, passed March 4th, 1826, gives the company a writ of ad quod damnum in case of disagreements as to the value of land through which their canal may pass.
129. An act concerning the Snicker's Gap turnpike company, allows further time to complete their road.
130. An act concerning Mathew H. Rice and his sureties.
131. An act to raise a sum of money by lottery to connect the Staunton and James river turnpike with the Kanawha road at or near its Eastern termination, authorizes fifty thousand dollars to be raised for that purpose.
132. An act providing for the publication and sale of the Map of Virginia, and for other purpose.
133. An act concerning J. B. Richardson.
134. An act authorizing representatives to sustain or revive actions in certain cases of trespass, provides that where the injury or trespass has been committed on slaves or other personal property, the action may be revived after the death of the injured party as actions in form ex contractu.
135. An act making further provision for the preservation of public records, authorizes the county courts to cause such books as they may deem necessary to be re-bound, and permits the Clerks of Courts to take them out of the county for that purpose, requires the Clerk of Hampshire to transcribe a certain book in his office: and requires the Executive to cause to be printed all the Journals of both Houses of Assembly; and of the Convention which adopted the Federal Constitution, to be held subject to the future order of the General Assembly.
136. An act releasing to the children of Geo. Carson a tract of land, whereof he died seized.
137. An act incorporating a company to open and improve the navigation of Chickahominy river, authorizes them to take subscriptions to the amount of fifty thousand dollars for that purpose.
138. An act concerning the town of Wheeling in Ohio county, gives the Mayor and Commonalty the power to erect and establish public landings, wharfs, and quays on the margins of the Ohio river and Wheeling Creek adjoining the town.
