Unpledged Candidates Stay Out.
A number of appeals for relief have been made to Attorney General Moose by candidates who failed to get their pledges filed in time as prescribed by the corrupt practices act. The most notable instances are W. W. Allbright, candidate for state senator from Boone county, and J. C. Cash, candidate for assessor of Arkansas. Mr. Cash came to Little Rock and called personally upon the attorney general for advice.
Judge Moose has advised all of them that he knows of no way in which they can get relief from their oversight, and that in view of the penalties prescribed in the act it would be best for them to make no effort to get on the ticket.
The statute specifically prescribes that all candidates in a primary election shall file their pledges with the designated authorities not less than 30 days preceding the election, and another section provides a penalty of not to exceed $1,000 or imprisonment not exceeding one year, or both, for a violation of any provision of the act. Therefore a strict interpretation of the act would mean the prosecution of any candidate who persisted in placing his name before the people, despite his failure to file the pledge as required by law.
