Trial For Assault And Battery --Michael Walsh and Lorenzo D. Cummings impleaded with others, were tried for an assault and battery on Abraham B. Millard, of 319 Hudson street, on the 28th August last, at the election held at the corner of Hudson and Charles streets, in the 6th ward. for the choice of Delegates to the Syracuse Convention. Mr. Millard deposed that two men, Wilsons, one with one arm. came in to vote: that Walsh said they lived in the 5th ward which they denied and offered to swear their vote in; when they went out Walsh attacked the larger man, and others the one armed man, and got them down, beating them terribly Witness seeing it, cried out "My God, dont kill the man. when he was hustled about, his hat knocked off, and that Walsh then struck him, others held him from behind, his head was held down, and he was terribly beaten by a num-ber, his face cut and bruised before he could extricate him self.

Witness could not tell by whom he was beaten. He saw Cummings after he got up, who said -I will give you more if you want it." Walsh had only his coat and pantaloons on, and Cummings had his coat off. There were 6 or 7 en-gaged in the attack on me. There were four on the one-armed man in the gutter. Witness gave no provocation; is not certain that either Walsh or Cummings hit me, saw Walsh strike at me.

James C. Mc. Adam--Saw both the accused in the com-pany who beat Millard and Wilson; did not see them strike the former, but saw Walsh strike at him. Walsh also slapped witness in the face. Thought Walsh was the leader, as they came to know his orders.

Peter Provost--Saw Millard Reed held down, and Cum-mings beating him with his fist in the face, and marked Cummings to know him, did not observe Walsh. Witness is Captain of the Third District Watch

Cross-examined, by Walsh--There was an apprehension on the part of inhabitants of the Ninth Ward that there would be a disturbance. They applied to Justice Gilbert. who ordered the watch to be in attendance at 5 o'clock--did not see any watchmen there besides myself. I saw you (Walsh) examining a man's head for his bumps and also his pockets. You said his bump of destructiveness was largely d-eveloped--he had his clothes torn off at the time.

Edward Barlow saw Cummings strike at Millard--did not see Walsh do any thing.

William Snell thought the men in the affray were under the control of Walsh. Mr. Griffith and Mr. Bush also thought Walsh the leader of those who were in the affray.

Prosecution rested.

Mr. Camp opened for defence and called Mr. Gedfry, who deposed that Cummings did not go into the mob until Mil-lard was beaten. Some 5 or 6 witnesses for defence deposed that they saw the row and men beating Millard, but that Walsh and Cummings were not the persons that beat him, and that Walsh requested "the boys" to preserve order and let the voters come in. Mr. Camp summed up for defence.

After some remarks from Mr. Walsh, the District Attor-ney summed up, and after a charge from the Court, the Jury retired. After an absence of about half an hour, they found a verdict of guilty against both the parties.
