THE DISTRICT COURT
The district court convened yesterday morning at 9 o'clock, Judge J. B. Sener on the bench.
Matthews vs McDaniels. Report of special master commissioner Riner submitted and confirmed, and decree ordering the delivery of a proper deed. The property involved is the McDaniels block.
Territory of Wyoming vs Thomas Lewis and Lewis Worthington. Defendants arraigned and pleaded not guilty. Separate trials were demanded, and set for Thursday and Friday. The defendant Worthington then desired to withdraw his plea of not guilty and to plead guilty. The court remanded him to jail for sentence after the trial of Lewis. Fisher for Worthington; Corlett for Lewis.
A venire for four talesmen was ordered for Friday at 9:30 a. m.
Davis vs Newcomb & Co. Motion to quash service of summons argued and taken under advisement. Corlett for motion, Baird for plaintiff.
An order was entered for counsel fees of $25 in favor of Judge Fisher for defending Worthington.
United States vs Christian Madsen. On motion of district attorney, a nolle pros. was entered and the defendant finally discharged.
The grand jury presented an indictment against Wm. Morgan and Oley Jensen, charged with grand larceny. Defendants being without counsel, the court assigned Mr. Mann to defend Morgan, and Mr. Carroll to defend Jensen.
Roche & Plunkett vs Searight. Judge Brown, of attorneys for plaintiffs argued against motion to strike out certain portions of the petition. As the question involved is a new one in our courts, and the alleged damages heavy, to-wit: $20,000, considerable interest is manifested by the bar and others. Judge Brown's argument yesterday was an able exposition of the measure of damages claimed by plaintiffs. Mr. Corlett will reply this morning for defendant.
Territory of Wyoming vs James Smith, charged with grand larceny. J. C. Baird appeared as counsel for defendant who will be arraigned this morning.
The grand jury came into court at five o'clock and were excused until 9:15 o'clock this morning; the court will convene at 9 o'clock.
