COUNTY MUST PAY PART If Town Votes for Road Improvement, County Must Stand Proportion.

If a town votes a tax for improvement of a county road, the county must pay part of the cost of the improvement, even though the road is also a part of the state trunk highway system. This was the ruling of the attorney general last week.

When a town meeting has voted a tax for the improvement of a designated portion of the county system of prospective state highways, according to the opinion, it is mandatory upon the town board to petition the county board to appropriate at least an equal amount for the improvement and it is mandatory upon the county board to make such appropriation, even though the designated portion is also a part of the state system.

The county system of prospective state highways is a complete system in itself, independent of the state trunk or other systems of highways, it was held, and the fact that a portion of the county system has become a part of the state system is immaterial.
