Favor of Cow Owner
A damage case resulting from the collision of a car and a cow in Garrett county ended early yesterday in Allegany County Circuit Court.
A jury returned a verdict in favor of the owner of the cow that was killed when it was hit by a car.
Judge George Henderson presided at the hearing removed from the Garrett County Circuit Court.
Alvie Leighton, Oakland, entered suit in Garrett County Circuit court for $584.58 damages against Charles I. Blamble, who lives three miles north of Gorman along Route 50.
Leighton's attorneys, W. Dwight Stover, Oakland, and William H. Geppert, Cumberland, argued that Blamble's cow jumped into the path of Leighton's car on the night of June 16, 1954. As a result of the impact the car received damages totaling $584.58. The cow was killed, testimony revealed.
The plaintiff claimed that the morning after the collision, he and Blamble went to the scene and found the cow had reached the road after going through a hole in the Blamble fence.
Blamble and his attorney, S. R. Pagenhardt, contended that the hole in the fence was made by a neighbor's cow as it tried to get into the Blamble field where there was a bull grazing. One of the witnesses, Elliott Devers, who resides near Blamble, stated that his only cow at certain times of the year would jump the fence to get near other cattle.
