Former Policeman Who Has Been Twice Sentenced to the Electric Chair.

ALBANY, N. Y., May 25.-The court of appeals today uncovered Sing Sing's chair of death for Charles Becker. His second conviction for the murder of Herman Rosenthal, unlike his first, was affirmed. The judges concurring in the decision included Chase, Hiscock, Collin, Cuddeback and Cardoza. Judge Hogan dissented. Judge Seabury who was the presiding officer during Becker's second trial, did not vote.
The court generally disapproved of Becker's alleged grounds for a retrial. These included "insufficient evidence to convict, improper testimony and judicial errors."
Charles Becker, a former police lieutenant of New York City, twice was convicted of the Rosenthal killing and twice sentenced to die in the electric chair. The court of appeals, which previously laid aside the first trial's judgment, now refuses to interfere with the second trial. The affect of today's decision besides denying Becker another opportunity to wage legal war for his life, loosens the stay which has prevented his electrocution.
