The motion to commit Burr, Blennerhassett, and Israel Smith, to Kentucky, for trial, was that day decided.
The Chief Justice delivered his opinion, that no overt act of levying war was proven to have been committed; but he was of opinion that there was probable ground
to believe that Burr and Blennerhassett were guilty of a misdemeanor in Ohio. They therefore committed them to Ohio for trial. Israel Smith was discharged, and Burr and Blennerhassett were admitted to bail in the sum of 3,000 dollars--Doctor Cummings and Luther Martin securities for Burr: Israel Smith and Doctor Cummings securities for Blennerhassett.--In our next we shall commence the publication of the interesting opinion of the Chief Justice, which closed this important examination.
