The second trial of Isaac B. Desha has taken place at Cynthiana, Ky. and lasted from the 21st ult. to the night of the 24th when the jury retired and in half an hour returned a verdict of guilty. Judge Brown, who presided, on motion of the counsel, on the ground that no evidence had been submitted to the jury proving where the murder was committed, promptly granted a new trial! It is said the frivolous pretence on which the judge acted has excited the astonishment of his friends & the indignation of the public. Gov. Desha, the father of the accused attended through the trial. Another version says an informality in the indictment, was the ground of the new trial being granted, the prosecuting officer having neglected to name the county in which the murder was committed. If this last be true the alleged cause is sufficient.
