The No-Fence Law.

This Act, which has received the Governor's signature, and which on casual reading seems unobjectionable, has its bad features. Commenting on it, the Silver State says: "While every reasonable person must concede that land owners should be protected from predatory herds and flocks, which devastate the country through which they are driven, none will deny the injustice of making the county pay for the arrest and prosecution of the alleged trespassers. An Act making the owner of live stock purposely herded on the unfenced lands of another liable for damages, though a long stride in advance of former legislation, would not be indefensible, but an Act which, in addition to his liability for damages, makes the owner of such stock a criminal, to be hunted down by the Sheriff or Constable, and prosecuted by and at the expense of the county, is repugnant to the sense of justice and fair play inherent in American citizens."
