Mr. McDowell said, as the appointment under discussion, is to be made for the Judicial Circuit of which I am a resident, it is but right that I should offer a word or two in explanation of the course in relation to it, which a call of propriety induces me to adopt I have known Mr Peyton for years— known him intimately, and well, and can, upon this personal knowledge, vouch for the statements which have been made by others to his high professional reputation; to his unquestionable capacity for legal investigation; to the acute, clear, industrious and business character of his understanding. This I can do, and do cheerfully; but whilst I can make this attestation to the professional merits of Mr Peyton, there exists reasons, satisfactory in themselves, but needless to be divulged, which induce me to forego the private gratification, which I should feel in supporting Mr Peyton, and leave the question at issue between him and Mr Thompson, to the decision of others Unable for these reasons, to support Mr Peyton, and yet more unwilling to prefer Mr Thompson over so unequal a competitor, I cannot do otherwise than so to render my vote, as to affect the election of neither
