The trial came on at the present term of the Circuit Court in Rochester, Judge Dayron presiding, on Thursday afternoon of last week. The nature of the case, and the standing and profession of the defendant, created great excitement with reference to the issue of the trial.
The counsel employed on the occasion were:
For the prosecution, Samuel L. Selden, Judge Sampson, Henry R. Selden, Graham H. Chapin, and Orlando Hastings.
For the defence. Mark H. Sibley of Ontario, Addison Gardner, Fletcher M. Haight, and E. B. Wheeler.
The testimony closed on Saturday evening, and on Monday morning, the Hon. M. H. Sibley commenced his speech for the defence, which occupied nine hours, and is spoken of as a most able, shrewd and eloquent effort. Mr. Sampson followed in behalf of the plaintiff, and after a clear and sound charge from Judge Dayron, the jury retired about 6 o'clock. After an absence of some four hours, they returned a sealed verdict of three thousand and twenty-five dollars damages for the plaintiff, Dr. Murdock, father of the young lady.—Buffalo Com.
