Boy Says Father Came to Him With Knife, He Fired; Story Upheld.
Missoula, Nov. 2.--(By The Associated Press.)-Leland Tucker, 21 years of age, was released from custody Thursday and the charge of murder in the first degree against him was dismissed, following a preliminary hearing in justice court. Young Tucker is alleged to have shot and killed his father, J. A. Tucker, near Lothrop, 30 miles west of here, on Friday. The boy told his story, which was one of self-defense. He was substantiated by his mother and two other witnesses. The witnesses of the affair declared the elder Tucker was advancing upon the boy with an open knife in his hand and declared that he would kill the boy. The boy backed away, they said, but as he could not escape, he fired, the bullet striking the father near the heart. The father called the boy, shook hands with him, declared he loved him and said, "You have done just what I wanted you to do," declared the witnesses and the boy on the stand.
