Anti-Near Beer Ordinance Held Valid By the Supreme Court.
The supreme court has handed down a decision whereby the near-beer ordinance drafted by the city council of Shellman will remain inviolate and in full rigor, prohibiting the sale of any "near beverage" containing more than a quarter of one per cent. alcohol and eliminating near-beer and practically every other concoction. An injunction was issued against the town ordinance, but the supreme court has ruled that the injunction doesn't fit the case, because of an old law that a court of equity cannot interfere with the enforcement of criminal laws. Judge W. C. Worrill of the superior court of the Pataula circuit granted the injunction which the supreme court now dissolves.
The suit for injunction was brought by W. T. Saxon to stay the operation of the ordinance. Saxon won out in the lower court, but he loses now.
Judge M. C. Edwards of Dawson represented the Shellman council in the litigation.
