THE COUNTY ATTORNEY
This morning the six sheepmen who were arrested in this city about five weeks ago while passing through this city with a flock of 1400 sheep, en route from Montrose county to Utah, on the charge of burning timbers from a county bridge across Whitewater creek, were arraigned for trial in the county court.
Some surprise was caused when Attorney Ben Griffith, the county attorney, and his partner, J. S. Carnahan, appeared for the defense of these men.
The warrants against the sheepmen were sworn out by a road overseer acting for the county and county commissioners; yet a county official, the adviser to the board of the county commissioners, appeared as one of the attorneys for the defense of these men.
District Deputy Attorney John H. Fry was present to conduct the prosecution, and he objected to the appearance of County Attorney Griffith for the defense on the grounds that Griffith should rightfully, as county attorney, be aiding the prosecution.
Mr. Griffith retired from the active defense in the case.
One of the two counts in the indictment against each of the six men was quashed, and the trial of the men on the remaining counts was entered into at 10 a.m. before County Judge Sullivan.
