Jack Gardner Goes To Benson
and It Is Alleged That He
Carries Sparklers Not His
Own Property.
Jack Gardner is out of town and with him, or alleged to be, to the value of $75 that do not belong to him. Jack McKay is the man who is chiefly mourning the departure of Gardner and to whom the diamond belonged.
Some time since, as McKay alleges, he was in need of a little change and soaked one of the diamonds. A little later he did the same with another, raising on the two about $25.
Thursday he had sufficient money ahead to take them out and alleges that he turned over the money to Gardner and asked him to redeem them for him. Gardner, it is alleged, carried out part of the instructions, but failed to carry them all out. That is, he redeemed the stones, but instead of turning them over to the proper owner, kept them, it is alleged.
At any rate he left here on yesterday afternoon's train for Benson.
McKay found out that Gardner had left the city about 5 o'clock in the afternoon. He immediately repaired to one of the justice courts where he was advised that the best thing he could do was to see a lawyer as to the proper steps to take toward the recovery of his property. This he did, and acting upon the advice given him, had the officers at Benson notified that Gardner was expected there this evening. Up to a late hour last night no news had been received as to Gardner's arrest.
Jack Gardner, the man who is alleged to have made away with the gems, has been working day shift at the Red Metal saloon, and his friends are very much surprised that the incident occurred and are hoping that some mistake will be proven.
