BIRMINGHAM, Ala. - (SNS) - Academically qualified students.
Alabama's celebrated "University Admission Case" is scheduled to be presented to the United States Supreme Court Monday, Oct. 3.
Atty. Arthur D. Shores, legal counsel for Mrs. Pollie Myers Hudson and Miss Autherine J. Lucy, prospective University of Alabama enrollees, revealed this week that such was the latest development in the effort to open the doors of the university to all qualified students without regard to race.
In the meantime it was learned that both Mrs. Hudson and Miss Lucy are ready, prepared and waiting to enter the University of Alabama as soon as the way is cleared for them to do so.
Lawyers for the University of Alabama won a last-minute stay of a court injunction opening the doors of the University of Alabama to all academically qualified students.
Shores sought to have the stay removed by appealing to the U. S. Fifth Circuit Court of Appeals where he was rebuffed. He then tried to get Supreme Court Justice Hugo L. Black to dissolve the delay order.
Instead of doing this, Justice Black said he would place the matter before the whole tribunal. U. S. District Judge Harlan Hobart Grooms in a ruling July 1 struck down the racial admission practices at the university. Then he granted a four-month delay to allow the lawyers for the university to prepare an appeal.
The stay will be up January 6, two weeks before the second semester begins at Alabama. Of course, the lawyers could ask for more time. But it would be up to Judge Grooms to decide on this request.
