We were of impression that the Proviso, at the end of this 7th section, "as only intended to apply to the last article mentioned, viz: "upon every pack of playing cards ten cents; and every merchant, shop keeper, and public dealer in goods, wares and merchandise shall state on oath how many packs he has sold within the last year;" and then follows the Proviso, which was obviously necessary, viz: "this enactment shall not be in force before the first of April, in the year 1850." Why? because no merchant called on the first of April, 1849, could tell how many packs he had sold within the last year, probably, because he had kept no particular account.
The section of the act as it stands, appears to us to be intended as a notice, that hereafter strict account is to be taken, and the number given in on oath. The word "enactment" in the Proviso, we learn, extends it to the whole section.
