The three men who have not yet faced trial in the February 8 holdup-abduction of two agents of a Westside business firm, are scheduled to be arraigned Monday morning in the court of Fulton Superior Court Judge Jesse M. Wood, it was learned yesterday.
The three men reportedly were prepared to enter pleas Wednesday immediately following the trial and conviction of Edward Alvin Spicer, 44, of 1078 Ashby Grove S. W. Holdup after attorneys for Spicer announced they intended to file a motion for a new trial.
Spicer's lawyers said Friday that they had "officially" notified the office of the Solicitor General that no motion would be filed.
Spicer was convicted for his part in the holdup just outside the Westside branch of Citizens Trust Company, which netted the alleged armed bandits $7911.33.
Spicer was accused of planning the holdup, but not actually taking part in physically seizing the two messengers who had just left the bank with currency for their firm's business for the day.
Unofficial sources indicated that all three men would plead guilty to the armed robbery charges. They had already testified for the state in the case against Spicer.
The remaining defendants were identified as Robert Lee Herndon, Jr., 29, of 795 Playlane N. W., Russell Early, 28, of a Simmons Street address and Johnnie Gamble, 28, of 34 Taliaferro St., N. W.
