CHICAGO, May 2. (ANP)--A war department offer to the National Bar association to conduct a study of army courts-martial proceedings independent of the official study being made by the American Bar association was rejected through Earl B. Dickerson, NBA president.
Basis of NBA's rejection, said Dickerson's letter, was that no group or individual could make an intelligent inquiry into the army system of administering justice without access to army records and the individuals responsible for the administration of military justice.
Any inquiry on the basis of the army court-martial manual and the published decisions of the Judge advocate general would be superficial and without substantial merit." Dickerson told Kenneth C. Royall, under secretary of war.
"In behalf of the National Bar association," the NBA president wrote, "I must therefore respectfully decline the invitation tendered me through Mr. Ray."
Dickerson assured Royall that his "action should not be construed as reflecting any lack of interest in the subject matter of the American Bar association investigation. If the war department makes available the proper facilities for a complete investigation on the part of other and more representative organizations, the National Bar association will be happy to join in such a study."
Dickerson criticized a few weeks ago the war department's failure to include the NBA along with the ABA to investigate army court-martial proceedings on the ground that Negro soldiers were charged with more than their quota of infractions of army regulations.
