Calvin Kellner, a father of two motherless children, a man of impeccable character and one of the striking printers, was convicted in City Court of a charge of assault, preferred by an admittedly imported strikebreaker on the Miami Daily News. Kellner's only crime, as the testimony showed, was that he made a date to meet the strikebreaker at which time he (the strikebreaker, Koehler) had agreed to sign an affidavit he had been brought here by the Daily News to take the place of striking printers.
When Kellner and two other members of the Union kept this appointment with Koehler, and shook hands with him, a police officer appeared and arrested them, also without cause or without a warrant.
It would seem that the powerful Herald and News combine not only can have innocent people picked up without a warrant, but they can also cause them to be found guilty.
What is even more an evidence of the doubt on the part of the court as to the honesty of the evidence presented by the plaintiff was the fact that the defendant Kellner, while having been found guilty also had sentence suspended.
This, of course, gives both dailies the chance to publicly proclaim a law-abiding citizen to the world as on a par or even lower than the "rats" they import to do their dirty work.
J. Fritz Gordon, attorney for the Typographical Union, will appeal the decision.
