DYE'S MOTHER

First Witness Sworn at the Wooster Murder Trial.

SECOND ORRVILLE TRIP

Wooster, O., Feb. 25.—After spending Monday forenoon in Orrville visiting the scenes connected with the Dye murder case, the members of the special jury which will hear the case returned to this city at noon. They were taken at once to the court house.

Attorney Lyman Critchfield for the defense stated that he was not satisfied with the viewing that the members of the jury had done in that there were not ordered to go to the city buildings at Orrville nor to the pool room and saloon that the boys are alleged to have been in during the day of the murder.

After discussion Judge Eason stated that court would be held until 4 o'clock in the afternoon and then the jury would again be taken to Orrville to visit the places suggested by the attorney for the defense.

At 1 o'clock the court opened and after the lawyers had stated their case the first witness, Mrs. Nancy Dye, mother of the young boy who was murdered, was placed upon the stand.

The mother was clad in deep mourning and answered all the questions of the attorneys readily. She told of the eventful night and that she had not seen her boy alive since the noon hour on the 12th of April, 1906.

The mother bore up well under the strain until a picture of her deceased son was placed before her. At this time she could not control herself longer and wept bitterly. "Yes, that is the picture of my boy who I will see no more," she stated between sobs.

Philip Markley and Sylvester Minks were the only other witnesses that were examined Monday afternoon and their testimony was of little value concerning the case.

At 4 o'clock the court adjourned and the jury, accompanied by the sheriff, took the 4:31 train to Orrville. They viewed the city prison, the mayor's office and the saloon in question and returned to this city at 6:30.

It is expected that much of the state's testimony will be introduced Tuesday.
