Little Rock, Dec. 12. - The United States circuit court of appeals at St. Louis had dismissed the appeal of E. H. Lake, who was ordered by Judge Trieber on January 24 last to pay into the registry of the court $60,953.72, which it was found he had failed to account for after the failure of the Alphin-Lake Cotton Company with the provision that if he failed to pay the amount within thirty days after the order was entered he should be confined in the Pulaski county jail until the further order of the court.
The action of the circuit court of appeals is considered here to be final, and if this is true Lake will be required to fulfill the conditions of Judge Trieber's order. This would mean that he would be compelled to pay into court $60,954.72 or go to jail to remain until the court should order his release.
