FRIDAY, MARCH 17.
Mr. Chief Justice Marshall delivered the opinion of the Court in the case of the Atalanta, Fawset, claimant, which had been ordered to further proof at a former term, and was now condemned.
The Court continued the case of the Amiable Isabella, Munos, claimant, (argued by the Attorney General, Mr. Pinkney, and Mr. Wheaton for the captors, and by Mr. Harper & Mr. Gaston for the claimant,) to the next term, for advisement.
Mr. Justice Johnson delivered his opinion in this case, that the claimant was entitled to restitution of the property as claimed, upon the ground that the ship and cargo were protected by the passport under the Spanish treaty of 1796 from belligerent seizure and condemnation as prize.
The Court adjourned, sine die.
