Chicago, May 24. Judge Tuley gave a decision yesterday in the civil-service mandamus proceedings instituted by John Barton Payne, representing the Civil Service Reform league. He held the recent promotion of police officials to be illegal.
The following reductions will be made in the department as a result if the decision is upheld by the Supreme court: John Ptacek, reduced from assistant chief to patrol sergeant; Max Heidelmeier, reduced from inspector to lieutenant; John J. Hartnett, reduced from inspector to patrol sergeant; Luke Kallas, reduced from inspector to patrol sergeant.
Reason for the Judge's Decision.
Judge Tuley holds that the examinations for these grades should have been made promotional and confined to members of the department holding the next lowest rank. This means that captains only are eligible to take the examination for inspectorships, and that the assistant chief must first be an inspector. The court held that the civil-service commission has no right to decide whether examinations shall be original or promotional. Such construction, he said, would leave the civil-service open to the evils that it was intended to prevent.
