A singular case was last week brought before the Court of King's Bench. A man named Bourne and two others having been convicted of burglary at the Monmouth sessions, and sentenced, Bourne to seven years' transportation, and the others for life, the prisoners filed a bill of error, alleging that the offence of which they had been convicted being capital, they ought to have been sentenced to death. The court, on the authority of Lord Chief Justice, sanctioned by the united bench, decided that the judgment was erroneous, and must be reversed. The prisoners, in consequence, were discharged.
