In the interesting libel case tried this week in the municipal court, the jury after being out all night, gave a general verdict, that Dr. Samuel Thompson was guilty. It is said, they unanimously agreed upon the first vote upon the merits of the case, that the publication was libellous, and Dr. T. had not sustained his charges against Dr. Badger, but that one of the jury had conscientious scruples, that libelling was not a criminal offence in this State, a position advocated on this as on former occasions by Mr. Hallett, defendant's counsel. After some explanatory remarks from Judge Thacher, answering some questions put to him by the jury, they retired to their room again, yesterday morning [April 12,] and returned in half an hour with the verdict of guilty. Dr. T. was informed he had a right to appeal before sentence, as the law now was, but the Doctor's counsel said he wished to hear the sentence first, before he decided whether to appeal or not. Sentence will be passed this morning.
