Respondent's Brief Is Filed by Nagle
Respondent's brief was filed a few days ago with the Montana supreme court by Attorney General Raymond T. Nagle's office in the case of Harry Miller, who is appealing from a conviction on a grand larceny charge in Garfield county.
Miller was accused of theft of a mare belonging to Henry J. Behmerwold. He alleges the animal was one of 20 sold by him to a horse buyer residing at Moore and shipped from Winnett to Trevor, Wis.
Miller admitted selling and shipping the mare, but contended he had obtained the animal from a son of Behmerwold by trading another horse for it. This was denied by the son, and Miller was found guilty by a jury.
