The Boston Herald of yesterday had the following concerning the assault of Lowell upon a posse of officers who came to his house to take goods to which one Brown held claim. This last development alters the appearance of the case as it was published some days ago:
"Very many people who have read what has been published about the 'Buckingham street scrimmage,' telling how severely and dangerously the man Thomas Tracy was assaulted by Mr. Lowell, are wondering why it is that Lowell has not been prosecuted for assault. There are several reasons, but the principal one is that as yet Tracy and his friends have been unable to get a warrant from the justices of the police court for the arrest of Lowell, as it seems to be well understood that Tracy and his party were acting without any precept. Many of the facts in the case have been given, but it being a badly mixed up affair, involving a number of business operations and extending over a long period of time, it is hard to explain it in full, or to do justice to the parties concerned. The action of the court seems to indicate that Brown had no legal claim on the property; that Tracy and his posse went to take the furniture out of the house, and that Lowell fully understood this, hence his violence and efforts to protect his home. He did not, however, throw any big stone at Tracy and hit him on the head. He did, however, take from Tracy his billy and with it gave him a very severe pounding. At first Mrs. Lowell was all alone, and could not prevent the intruders from entering. But she communicated with her husband as speedily as possible, and when he arrived Tracy was pounded—and badly pounded. But only through the court where the matter may soon be ventilated, can the full particulars of this affair come. That Brown's claim is only a pretended one Mr. Lowell says he is prepared to prove, and had it been a just one he should have made no resistance, as he claims to be an entirely peaceable man. Mr. Lowell dared to protect his home, and the court will not permit his arrest for it."
