June 25. Came on a long depending Trial between the Hon. Capt. Montague, Plaintiff, and Admiral Knowles, Defendant.

The Plaintiff when under Command, fired into a Boat, in Order to make her come to in the Night Time, as there was a Suspicion of Frenchmen being aboard, by which a Negroe was shot in the Leg, and died the next Morning; upon which the Capt. was deprived of his Command, and a Trial refused him, nor was he suffered to throw himself on the Law of the Island of Antigua:

These Circumstances being Proved, and the Captain's Honour sufficiently cleared, the Cause was stopped, and tho' large Damages might have been recovered, he was satisfied with a Verdict and ten Guineas, and Costs of Suit.
