At 10 o'clock this morning E. S. Kendrick, convicted of murder in the second degree, appeared for sentence. J. W. Dorsey Esq., his attorney, moved that sentence be postponed until 1 o'clock P. M., in order to give him time to confer with his client, and it was so ordered.

At 1 o'clock the defendant appeared in Court, and no legal cause being shown why judgment should not be pronounced against him, the decree of the Court was that E. S. Kendrick be incarcerated in the Nevada State Prison during the term of his natural life. A few facts in reference to the criminal and his crime may be of interest to the public.

In February, 1883, E. S. Kendrick, who had formerly served as a U. S. soldier in the company stationed at Fort Halleck, was tried on a charge of assault with intent to kill Lena Labriska, a sister of his wife, the alleged assault having been committed at Fort Halleck on the 13th day of December, 1887, during the progress of a dance at that place. On the 18th day of February, 1888, the jury presented a verdict of "assault with a deadly weapon with intent to do bodily injury," and on the 20th day February, 1888, Kendrick was sentenced to a term of fifteen months in the State Prison at Carson City. On March 9, 1889, he was discharged from that institution, having been granted a rebate of 2 months and 15 days from his sentence for good behavior.

During the latter part of the period of his term of imprisonment, his wife, Francis A. Kendrick, n-e Frances A. Labriska, petitioned for a divorce, which was granted March 11, 1889. On the previous evening, March 10, 1889, Kendrick arrived here and the next day made attempts to see his former wife, but she succeeded in keeping out of his way, as she frequently stated that she was afraid of him and did not wish to meet him. Kendrick remained in the county until the 23rd day of August last when, armed with a rifle, he went to Hugo's ranch in Lamoille Valley, where he found Otto Hugo (who some years since married Mrs. Labriska) in company with Lena and Robert Labriska, his step-children, and Kendrick's two little children. Hugo was digging potatoes. After speaking to Lena, Kendrick went toward Hugo who was at some distance and, according to the testimony of Lena and Robert, called to him and then shot him dead on the spot. Hugo never spoke after he was shot and Kendrick made his escape, but was afterward arrested and lodged in jail. On the 7th day of October the Grand Jury indicted him for murder, he was placed on trial October 28th and on October 30, 1889, the jury returned a verdict of murder in the second degree, whereupon he was sentenced to the State Prison for life, as above stated.
